eScholah.com provides a comprehensive school management system including but not limited to academic management, attendance tracking, fee management, library management, hostel management, transport management, and related services.

3.1 Cloud-Hosted SaaS Only

eScholah.com is provided exclusively as a cloud-hosted Software-as-a-Service (SaaS) solution. All services are hosted and maintained on our secure servers. We do not offer self-hosted or on-premises deployment options.

3.2 No Self-Hosting

Self-hosted deployments, on-premises installations, or provision of source code for independent hosting are not available under any circumstances. The Service is accessible only through our official web platform at eScholah.com.

The Service, including all software, source code, designs, text, graphics, and other content, is the exclusive property of eScholah.com and is protected by copyright, trademark, patent, and other intellectual property laws of Zimbabwe and international treaties.

6.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes only. This license does not include:

The software powering eScholah.com is proprietary and confidential. Any attempt to decompile, disassemble, reverse-engineer, or otherwise attempt to discover the source code is strictly prohibited and may result in immediate termination of service and legal action.

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY ZIMBABWE LAW, IN NO EVENT SHALL ESCHOLAH.COM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Upon termination, we will retain your data for 30 days to allow for data export. After this period, all data will be permanently deleted unless required to be retained by law.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Zimbabwe, without regard to its conflict of law provisions.

11.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.

11.3 Dispute Resolution

Before initiating any legal proceedings, parties agree to attempt to resolve disputes through good faith negotiations. If negotiations fail, disputes may be submitted to mediation before proceeding to litigation.

eScholah.com shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

If any provision of these Terms is found to be unenforceable or invalid under Zimbabwe law, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

These Terms constitute the entire agreement between you and eScholah.com regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
