By accessing and using eScholah.com ("the Service"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service. These terms are governed by the laws of Zimbabwe.
eScholah.com provides a comprehensive school management system including but not limited to academic management, attendance tracking, fee management, library management, hostel management, transport management, and related services.
eScholah.com is provided exclusively as a cloud-hosted Software-as-a-Service (SaaS) solution. All services are hosted and maintained on our secure servers. We do not offer self-hosted or on-premises deployment options.
Self-hosted deployments, on-premises installations, or provision of source code for independent hosting are not available under any circumstances. The Service is accessible only through our official web platform at eScholah.com.
eScholah.com is solely responsible for:
All client data is stored on our secure cloud infrastructure. We maintain multiple backup copies and implement disaster recovery procedures to ensure data integrity and availability.
Users must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
eScholah.com complies with the Data Protection Act [Chapter 11:12] of Zimbabwe and all applicable data protection regulations. We are committed to protecting the privacy and security of personal information.
We collect and process personal data only for the purposes of providing the Service. This includes student records, staff information, academic data, and financial records. All data is encrypted and stored securely.
You retain full ownership of all data you input into the Service. eScholah.com does not claim ownership of your data. We act solely as a data processor on your behalf. Your data belongs to you and your institution at all times.
eScholah.com staff will never access your data without your explicit written permission, except in the following limited circumstances:
All access is logged and auditable. We will notify you whenever access to your data is required.
We implement industry-standard security measures to protect your data from unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet is 100% secure.
Each school's data is completely isolated from other schools in our multi-tenant system. Your data is never shared with, visible to, or accessible by other schools or users outside your institution.
The Service, including all software, source code, designs, text, graphics, and other content, is the exclusive property of eScholah.com and is protected by copyright, trademark, patent, and other intellectual property laws of Zimbabwe and international treaties.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes only. This license does not include:
The software powering eScholah.com is proprietary and confidential. Any attempt to decompile, disassemble, reverse-engineer, or otherwise attempt to discover the source code is strictly prohibited and may result in immediate termination of service and legal action.
While we strive for 99.9% uptime, we do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY ZIMBABWE LAW, IN NO EVENT SHALL ESCHOLAH.COM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
You agree to indemnify, defend, and hold harmless eScholah.com, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

You may terminate your account at any time by contacting [email protected]. Upon termination, you will lose access to the Service.
We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
Upon termination, we will retain your data for 30 days to allow for data export. After this period, all data will be permanently deleted unless required to be retained by law.
These Terms shall be governed by and construed in accordance with the laws of Zimbabwe, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.
Before initiating any legal proceedings, parties agree to attempt to resolve disputes through good faith negotiations. If negotiations fail, disputes may be submitted to mediation before proceeding to litigation.
We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
eScholah.com shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
If any provision of these Terms is found to be unenforceable or invalid under Zimbabwe law, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
These Terms constitute the entire agreement between you and eScholah.com regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
